1. SCOPE AND PURPOSE

These Terms of Sale govern all purchase transactions made on desknovra.com between:

And the Buyer:
Any individual or entity placing an order on desknovra.com for personal, non-commercial use.

By placing an order on desknovra.com, the Buyer accepts these Terms of Sale in their entirety. These Terms of Sale prevail over any other document, including any general purchasing conditions of the Buyer.

2. PRODUCTS

2.1 Product descriptions
Desknovra makes every effort to present its products as accurately as possible, including descriptions, photographs, technical specifications, and dimensions. However, minor variations in color rendering may occur depending on the display settings of the Buyer's device and shall not constitute grounds for a complaint.

2.2 Product availability
Products are offered for sale subject to availability. In the event that a product becomes unavailable after an order has been placed, Desknovra will notify the Buyer as soon as possible and offer either a full refund or an alternative product of equivalent quality and price.

2.3 Product modifications
Desknovra reserves the right to modify its product range at any time, including discontinuing products or updating specifications, without prior notice. Such modifications do not affect orders already confirmed.

3. PRICES

3.1 Displayed prices
All prices are displayed in US Dollars (USD) for the American market and Canadian Dollars (CAD) for the Canadian market. Prices are inclusive of any applicable taxes where required by local law.

3.2 Price validity
Prices displayed at the time of checkout confirmation are the prices applicable to the Buyer's order. Desknovra reserves the right to modify prices at any time without prior notice. Price changes do not affect orders already confirmed.

3.3 VAT
27 Agency — Verseux Titouan is not subject to French VAT pursuant to Article 293 B of the French General Tax Code. No VAT is therefore applicable to sales made by Desknovra.

3.4 Promotional prices
Promotional prices and discounts are valid for the duration indicated and within the limits of available stock. Desknovra reserves the right to modify or withdraw any promotional offer at any time.

4. ORDER PROCESS

4.1 Placing an order
To place an order on desknovra.com, the Buyer must:

  • Select the desired product, size, and finish
  • Add the product to the shopping cart
  • Proceed to checkout and provide accurate delivery information
  • Select a payment method and confirm the order

By confirming an order, the Buyer acknowledges having read and accepted these Terms of Sale.

4.2 Order confirmation
Upon receipt of the order, Desknovra will send the Buyer an order confirmation email summarizing the products ordered, the total price, and the estimated delivery timeframe. This confirmation acknowledges receipt of the order.

4.3 Contract formation
The sales contract between Desknovra and the Buyer is formed upon dispatch of the shipping confirmation email containing the UPS tracking number.

4.4 Order modifications
Orders may be modified or cancelled free of charge before dispatch by contacting support@desknovra.com. Once an order has been dispatched, modifications are no longer possible and the standard return process applies.

4.5 Order refusal
Desknovra reserves the right to refuse any order in cases of suspected fraud, payment failure, abnormal order quantities, or for any other legitimate reason. The Buyer will be notified and any payment already made will be fully refunded.

5. PAYMENT

5.1 Accepted payment methods
The following payment methods are accepted:

  • Visa and Mastercard
  • American Express
  • PayPal
  • Apple Pay
  • Klarna (installment payments)

5.2 Payment timing
Payment is due in full at the time of order placement, with the exception of Klarna installment payments which follow Klarna's own payment schedule.

5.3 Payment security
All transactions are processed through secure, PCI DSS certified payment providers. Desknovra does not store payment card data on its servers. All financial data is encrypted during transmission.

5.4 Payment failure
In the event of payment failure or rejection, the order will not be confirmed. The Buyer will be invited to provide an alternative payment method. Desknovra reserves the right to cancel any order for which payment cannot be successfully processed.

5.5 Invoice
An invoice or purchase receipt will be provided to the Buyer by email upon order confirmation. This document serves as proof of purchase and should be retained for warranty purposes.

6. DELIVERY

6.1 Shipping costs
All orders are shipped free of charge. No minimum purchase amount is required.

6.2 Delivery zones
Desknovra ships to the 48 continental United States and to the following Canadian provinces: Ontario, Quebec, British Columbia, Alberta, Saskatchewan, Manitoba, Nova Scotia, New Brunswick, Newfoundland and Labrador, and Prince Edward Island.

6.3 Processing time
Orders are processed within 1 to 3 business days of payment confirmation.

6.4 Delivery times
Estimated delivery times after dispatch:

  • Continental United States: 3 to 5 business days
  • Canada: 5 to 7 business days

These are estimates only and are not contractually binding. Desknovra cannot be held liable for delays caused by the carrier or by circumstances beyond its control.

6.5 Transfer of risk
Risk of loss or damage to the products transfers to the Buyer upon delivery of the order to the address provided at checkout.

6.6 Delivery issues
In the event of a damaged, lost, or undelivered package, the Buyer must contact Desknovra at support@desknovra.com within 48 hours of the scheduled or confirmed delivery date. Desknovra will initiate an investigation with the carrier and take appropriate action to resolve the situation.

7. RIGHT OF WITHDRAWAL

7.1 Statutory right of withdrawal
In accordance with applicable consumer protection law, the Buyer has the right to withdraw from the purchase contract without giving any reason within 14 days of the delivery date.

Desknovra extends this right to 30 days from the delivery date as part of its commercial commitment to customer satisfaction.

7.2 Exercising the right of withdrawal
To exercise the right of withdrawal, the Buyer must notify Desknovra before the expiry of the withdrawal period by contacting support@desknovra.com with their order number and a statement of their intention to withdraw.

7.3 Return conditions
Products must be returned unused, in their original packaging, and with all accessories and components included. Return shipping costs are covered by Desknovra.

7.4 Refund
Desknovra will process the refund within 5 to 7 business days of receiving the returned product. The refund will be issued to the original payment method used at the time of purchase.

7.5 Exceptions
The right of withdrawal does not apply to products that have been assembled, used, damaged by the Buyer, or returned without prior authorization.

8. LEGAL GUARANTEES

8.1 Legal guarantee of conformity
In accordance with Articles L.217-4 to L.217-14 of the French Consumer Code, Desknovra is liable for any lack of conformity existing at the time of delivery. The Buyer has 2 years from delivery to act under this guarantee. During this period, the Buyer may choose between repair or replacement of the product, subject to the cost conditions provided for by law. If repair or replacement is not possible, the Buyer may obtain a price reduction or a full refund.

8.2 Guarantee against hidden defects
In accordance with Articles 1641 to 1648 of the French Civil Code, Desknovra is liable for hidden defects in the product sold that render it unfit for its intended purpose, or that so impair such use that the Buyer would not have purchased it, or would have paid a lower price, had they been aware of them. This guarantee applies for 2 years from the discovery of the defect. The Buyer may choose between returning the product and obtaining a full refund, or keeping the product and obtaining a partial refund.

8.3 Commercial warranty
In addition to the legal guarantees above, Desknovra provides a 2-year commercial warranty covering defects in the motor, steel frame, control panel, and electronic components under normal use conditions. This commercial warranty does not replace or limit the statutory legal guarantees described above.

9. LIABILITY

9.1 Seller liability
Desknovra is liable for direct damages caused by a breach of its contractual obligations. Its liability is limited to the amount paid by the Buyer for the order in question.

9.2 Exclusions
Desknovra shall not be liable for indirect or consequential damages, loss of profit, or any damages resulting from misuse of the product, failure to follow assembly instructions, or events beyond its reasonable control.

9.3 Force majeure
Desknovra shall not be liable for any delay or failure to perform its obligations resulting from events beyond its reasonable control, including natural disasters, pandemics, strikes, government actions, or carrier disruptions. Desknovra will notify the Buyer as soon as possible and resume performance once the situation is resolved.

10. PERSONAL DATA

Personal data collected during the ordering process is processed in accordance with our Privacy Policy, available at desknovra.com/policies/privacy-policy, and in compliance with the General Data Protection Regulation (GDPR).

11. APPLICABLE LAW AND DISPUTE RESOLUTION

11.1 Applicable law
These Terms of Sale are governed by French law.

11.2 Amicable resolution
In the event of a dispute, the Buyer is invited to contact Desknovra first at support@desknovra.com in order to seek an amicable resolution. Desknovra commits to responding within 5 business days.

11.3 Mediation
In accordance with Article L.612-1 of the French Consumer Code, the Buyer has the right to use a consumer mediator free of charge in the event of an unresolved dispute. European Union residents may also submit a complaint to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

11.4 Jurisdiction
In the absence of an amicable resolution, any dispute arising from these Terms of Sale shall be subject to the exclusive jurisdiction of the competent French courts, without prejudice to any mandatory consumer protection rights the Buyer may hold under the law of their country of residence.
